Hereunder, I describe some of the areas of law I practice. This is not a limited list. Often, a concrete solution is found in more than one area of law. Criminal law

“Ignorance of the law is no excuse.” - Ignorantia juris non excusat

The law is a reproduction of the behaviour that we attend or not attend from each other.

In the field of criminal law, the defence of the accused and the presumption of innocence are the most important principles. If you are accused to have committed an offence, it is the task of the public prosecutor to provide sufficient proof.

Sometimes, the presumption of innocence is not respected properly. In such cases, the aid of a lawyer is crucial. Nobody wishes to end up in prison undeserved.

Traffic law

Did you commit a speeding offence? Were you drunk behind the wheel and did you hit a wall or worse, the front of a house? You will probably be summoned before a tribunal.

Once in court, you risk to losing your driver’s licence for a while and you will have to pay a significant fine. It’s also possible that you will have to retake your theoretic and practical exam before you will be able to regain your driver’s license. Also, the judge could impose psychological and medical tests.

In order to convince the tribunal to punish you in a fair manner, it is recommended to take a lawyer.

Contract and commercial law

Are you confronted with clients who do not pay on time or at all? Do you want to update your general terms and conditions?

Did you buy a new computer, tablet, smartphone and did the charging cable stop working after a few months? Is the purchase still under guarantee? What if the seller tells you it’s not?

Can an administrator of a company with limited liability be held responsible for debts of the company? What happens if the company is going bankrupt?

Tenancy problems

The competence of tenancy issues has been transferred from the federal stateto to the regions (Flanders, Wallonia and Brussels). This means that tenancy laws became local and could differ in the different regions.

Which law applies if you live at the border of Brussels, when your tenancy contract is in Dutch and you only speak French? What is the consequence of an arbitration clause in your tenancy agreement? How can you end your tenancy agreement? What do you have to do if you want to live in your apartment yourself and at the moment you are still renting it out? I will give you the answers.

Co-ownership and neighbour nuisance

We are living more and more in apartments. Hence, good arrangements between co-owners or co-habitants are very important. Discussions can occur if not everyone is complying with the common rules. The syndic can be contacted in the first place, whereas for legal problems advise from a lawyer is recommended.

A lawyer can also assist you during the meetings of the general assembly.
